On Thursday, the Auburn Police Department arrested a local man following an incident that began as an unwanted guest complaint and escalated into a burglary attempt at a local restaurant.
Officers initially responded to Curley’s Restaurant at 96 State Street at approximately 12:41 a.m. for a report of an unwanted guest. Police spoke with a man identified as Donald Filback. Restaurant employees reported that Filback had allegedly tried to fight other patrons and had thrown a chair after being asked to leave multiple times. Officers advised Filback that he was formally trespassed from the property, and he left without further incident.
Later that morning, at approximately 2:10 a.m., an officer conducting a property check at a nearby location heard loud banging and glass breaking coming from Curley’s Restaurant. Upon responding, the officer discovered Filback allegedly attempting to break into the restaurant.
When the officer approached, Filback tried to flee by jumping over a metal gate enclosing the restaurant’s patio. The gate broke, causing Filback to fall approximately eight feet to the ground. He was taken into custody and transported to Auburn Community Hospital by Auburn City Ambulance for injuries sustained in the fall.
A subsequent investigation revealed that Filback had allegedly broken a second-floor window in an attempt to enter the building before moving to the back patio. Once on the patio, he allegedly tried to smash his way through a French door using chairs and food caddies. In total, Filback is accused of damaging a window, four chairs, two food caddies, and the patio French door.
Filback was processed at the Auburn Police Department headquarters and transported to the Cayuga County Jail for centralized arraignment, where he was subsequently released on an appearance ticket.
