A Oneonta man is charged with felony assault after he allegedly bit off a portion of the ear of the person who told him he was not allowed to smoke at the state-operated Homer Folks Facility in Oneonta.

State Police say after Pierce Tobin was told he could not smoke by a staff member, the 31-year-old allegedly punched the victim in the face, causing visible bruising, before biting off a portion of their ear. The victim was treated at a local hospital.
