Inmate Dies After Assault at Marcy Prison

An investigation is underway after a prisoner at Marcy Correctional Facility died following an apparent assault inside the facility.

New York State Police said troopers were called to the Oneida County prison on May 16 to investigate an assault involving an incarcerated person who suffered life-threatening injuries.  According to investigators, correction officers discovered 45-year-old Terry Demonstoy unconscious in a bathroom shortly before midnight on May 15 with significant injuries. Demonstoy was transported to Wynn Hospital, where he was treated in the intensive care unit. State Police said he remained on a ventilator before being legally pronounced dead on May 18

An autopsy was scheduled through the Onondaga County Medical Examiner’s Office on Thursday.

Investigators believe Demonstoy’s injuries were sustained during an altercation with another incarcerated individual.

State Police said they are assisting the New York State Attorney General’s Office with the investigation. Under state law, the Attorney General’s Office has jurisdiction in cases involving deaths of individuals while in custody or when questions arise about whether a death was caused by the actions or omissions of law enforcement or peace officers.

The investigation remains ongoing.
