Bath Man Arrested Following Alleged Hammer Assault

On Monday, officers with the Village of Bath Police Department arrested a Bath man following a report of an assault involving a hammer.

At approximately 11:42 p.m., patrols were dispatched to a residence on Belfast Street. Upon arrival, officers observed a victim with wounds to their mouth consistent with being struck with a hammer. Police located the suspect, identified as David Hively, 62, of Bath, who lives in the same residence.

Following an investigation, patrols placed Hively under arrest. He was charged with one count of assault in the second degree and one count of criminal possession of a weapon in the third degree, both of which are class D felonies. Hively was subsequently transported to the Steuben County Jail and held due to his criminal history as a three-time convicted felon.

The charges are accusations, and the defendant is presumed innocent unless and until proven guilty. Police reports are automatically removed from this site after 90 days.
