A sergeant with the Bath Police Department suffered a severe head injury after assisting EMS personnel with a medical call in the Steuben County village.

After the sergeant and another officer arrived on the scene, 38-year-old David Cervantes, of Spencerport, allegedly became non-compliant and attempted to strike the sergeant with his elbow. After a brief altercation, the Monroe County man kicked the sergeant in the head.

After being taken to the hospital, it was determined Cervantes was under the influence of meth. He has since been charged with felony assault.

There was no update on the unidentified sergeant’s condition, other than he suffered trauma to the head.
