Geneva Man Accused of Raping Child Now Faces Federal Child Porn Crimes

A Geneva man arrested last week by Geneva City Police on child sex abuse charges is now facing federal child pornography charges following a joint investigation by local and federal authorities.

U.S. Attorney Michael DiGiacomo announced on Thursday that Rafael Arroyo-Ubiles, 27, has been charged by criminal complaint with production and possession of child pornography. The charges carry a maximum penalty of 30 years in prison, lifetime supervised release, and a $250,000 fine.

According to federal prosecutors, Arroyo-Ubiles came to the attention of the Geneva Police Department during a January investigation into illegal narcotics sales in the City of Geneva. Authorities say multiple search warrants were executed as part of the narcotics investigation.

While reviewing an online account allegedly belonging to Arroyo-Ubiles for evidence related to drug activity, investigators reportedly discovered videos depicting the sexual abuse of a 5-year-old girl.

Arroyo-Ubiles appeared before U.S. Magistrate Judge Colleen D. Holland and was ordered detained.

The case is being prosecuted by Assistant U.S. Attorney Kyle P. Rossi. The investigation involved the Geneva Police Department, led by Chief Ronald Eveland, and the Federal Bureau of Investigation.

The federal charges follow Arroyo-Ubiles’ arrest by Geneva Police on April 30. At that time, investigators charged him with first-degree rape, first-degree sexual abuse, and use of a child in a sexual performance following the execution of search warrants at residences in Geneva and Seneca Falls.

The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent unless and until proven guilty.
